Refund and Cancellation Policy

Last Updated: November 4, 2026

This Refund and Cancellation Policy applies to subscriptions to the Benson Service and is incorporated into the Benson Software-as-a-Service Customer Agreement (the “Customer Agreement”). Where this Policy and the Customer Agreement differ, the Customer Agreement controls.

1. HOW BILLING WORKS

A Benson subscription consists of a base fee of $495 per month and an employee-capacity tier selected at checkout. Fees are billed monthly in advance on the day of the month on which the subscription started and are charged to the payment method on file through Stripe, Benson’s payment processor. A subscription renews automatically for successive one-month periods until it is cancelled. The plan, fees, and capacity selected at checkout are the Order Form for the subscription.

2. CHANGING CAPACITY

The primary administrator may move to a higher capacity tier at any time; the higher tier takes effect immediately, and the prorated difference for the rest of the current billing period is added to the next invoice. A move to a lower tier takes effect at the next billing date, provided the organization’s employee count fits the lower tier.

3. CANCELLATION

The primary administrator may cancel at any time by emailing info@bensonhr.com from an address on the account, or by using the cancellation control in the Service where available. Cancellation takes effect at the end of the paid billing period in which it is received. The Service remains available until then, and no further charges are made after that date. Benson will confirm the cancellation and the end date by email.

4. REFUNDS

Fees are paid in advance for each monthly period and are non-refundable and non-creditable, including for partial periods, unused capacity, or a cancellation made part-way through a period, except where a refund is required by law or expressly agreed by Benson in writing. If Benson terminates a subscription other than for the customer’s breach, Benson will refund the prepaid fees allocable to the period after termination.

5. FAILED PAYMENTS

If a payment fails, Benson will retry the payment and notify the billing contact. Benson ordinarily allows ten (10) calendar days before suspending the Service for nonpayment. Access is restored when payment succeeds. Benson may act sooner in cases of fraud, payment abuse, or security risk.

6. PRICE CHANGES

Benson may change prices with at least thirty (30) days’ notice by email to the primary administrator. A change applies from the next billing period after the notice period and never to a period already paid. The customer may cancel before the new price takes effect.

7. YOUR DATA AFTER CANCELLATION

For thirty (30) days after a subscription ends, the customer may export its data from the Service. After that export window, the organization’s data is deleted from active systems within thirty (30) days and from encrypted backups as they rotate, within thirty (30) days after that.

8. QUESTIONS AND BILLING DISPUTES

Questions and claimed billing errors should be sent to info@bensonhr.com. Benson will investigate and correct any error it confirms.
